RULES FOR ATHLETES & COACHES

Values
Propel Pro values the pursuit of peak performance by athletes with the steady guidance of experienced coaches while promoting respect, integrity, teamwork, fair play, inclusivity and an enthusiasm for sports. The actions by athletes and coaches are expected to exemplify these values. These values are integral to how we interact with one another in the community, and how we create opportunities for skill development, mentorship and success at every level of sport.
Rules
Compliance with the below Rules are required of Propel Pro athletes and coaches while interacting on the Propel Pro websites ("Sites"), mobile applications ("Apps") or other communication services (collectively, "Services").
General Conduct
- Respect the rights of every person, including athletes and coaches. Communicate respectfully with one another on the Services.
- Protect the integrity of your sport by ensuring your actions are aligned with the sport, Propel Pro values, and state and federal laws while using the Services.
- Do not engage in behavior while using the Services that results in the harassment, abuse (physical, verbal, sexual or otherwise), provocation, bullying, hazing, or stalking of others.
- Refrain from any action while using the Services which is likely to discriminate against any other person based on a protected class, including gender, race, color, disability, age, religious or political belief, sexual orientation, national origin, ancestry, marital or civil partnership status, or pregnancy.
- Do not argue with the advice of coaches while using the Services.
- Avoid inappropriate conduct such as offensive language and gestures while using the Services.
- Never entertain or encourage match fixing including tanking matches, data manipulation or other cheating behaviors while using the Services. Encourage the use of best efforts by an athlete to win in competition.
- Do not use the Services while under the influence of a substance that may negatively impact your ability to provide or receive Services including recreational drugs or illegal substances.
- Do not engage in sports betting on Propel Pro athletes.
- You are responsible to ensure that no photographic or recording devices are in use if an athlete is unclothed, changing clothes or engaged in any other activity, private in nature, that is typically reserved for locker rooms.
- Disparagement of Propel Pro, its officers, directors, employees or affiliates is prohibited. For the provision of constructive feedback from athletes about coaches or the Services, please see Guidelines for Reviews in the Terms of Service.
- If you are a coach, and an athlete is undergoing an emergency situation while using the Services under your purview (including, but not limited, while on a live call), we recommend you call 911 to connect to emergency services in the state in which the athlete is located (if possible), and/or call the athlete's emergency contact.
- You agree to be bound by policies issued by Propel Pro, including without limitation, the Privacy Policy, Terms of Service, End User License Agreement, and the Assumption of Risk and Waiver (found in the Terms of Service and the Coach Service Agreement). In the event of a dispute between an athlete and coach which does not involve Propel Pro's gross negligence or willful misconduct, you further agree to defend, indemnify and hold Propel Pro and its parent, subsidiary and affiliated companies and the directors, officers, employees and agents of each, harmless from and against any and all third party claims, damages, liabilities, costs and expenses, including but not limited to reasonable attorneys' fees and expenses, arising from or relating to such dispute.
No Unpermitted Group Sessions or In-Person Meetups
- Multiple athletes are not permitted to partake in Services without being an authorized participant in a group session, where group session rates must be charged and paid for.
- In-person meetups are not permitted unless at a sanctioned Propel Pro live event.
Rescheduling / Cancellations / Response Times / Services Refund Requests
- Avoid rescheduling or cancelling Services within 24 hours of your set appointment time ("Window"). If you are an athlete and you cancel, reschedule your Service time inside this Window, or you don't show up to your Service, you will be charged the full price as if the Service took place. If you are a coach and you cancel, attempt to reschedule your Service time inside this Window, or don't show up to your Service, the athlete may be assigned to another coach and may be entitled to a refund if charged in advance for the Service that did not commence.
- If you are a coach, you should respond to an athlete's outreach or query within 24 to 48 hours of receiving such outreach or query.
- If an athlete is dissatisfied with a coach's services, a coach's attendance issues, or a coach's response times, the athlete may contact Propel Pro at care@propelpros.com and request a review of the Services. Propel Pro may review the Services and resolve the matter at its sole discretion, including a refund for the Services. Refunds are further governed by the Propel Pro Terms of Service and any specific refund policy stated at the time of purchase.
Permitted Downloads & Recording Usages on Social Media
- A coach's drills are considered confidential and proprietary information ("Coach Drills"), and are not permitted to be downloaded (or screen-recorded) or shared with others. If you have any doubt as to whether you're permitted to download and/or use drills publicly, you are expected to contact the coach and/or Propel Pro at care@propelpros.com to inquire.
- Materials available through the Services other than Coach Drills, including without limitation, a Coach's introductory or greeting video or audio recording or chat, a Coach's fun action-shot videos, a Coach's instructional feedback, an athlete's video or audio recording (posts including minor athletes require explicit permission from a parent or legal guardian and cannot mention last names), or generic drills not from a specific coach ("Propel Pro Materials"), are permitted to be downloaded and shared through your social media channels, with a time limit of not longer 60 seconds of a video or audio recording (wherein such time limit is subject to change at Propel Pro's discretion). Propel Pro grants you a limited, revocable, non-transferrable, license to the Propel Pro Materials as detailed in this section; provided, however, the music on the Services that might be integrated into such Propel Pro Materials may not be downloaded or re-posted publicly due to potential licensing limitations. Public postings on social media accounts must include the Propel Pro logo as it is embedded in such Propel Pro Materials (if applicable), and we encourage the use of #propelpro in your message.
- If you are an athlete, the videos and audio recordings and drills exchanged with your coach through the Services will remain available to you through the Services, regardless of whether you are currently paying for Services (e.g., a subscription fee or other transaction fee), with the exception of accidental deletion or otherwise due to a force majeure event outside the control of Propel Pro.
Products Collecting / Using Athlete's Biometric and Health Data
- At times, products may be offered for sale or use through the Services that collect and use an athlete's biometric data for a coach's analysis in order to improve athlete performance and/or prevent athlete injury or other business purposes. Such biometric data may include, without limitation, physical metrics such as heart rate, pulse, oxygen levels, perspiration, distance, speed, acceleration, deceleration, and load. Before such biometric data can be exchanged between an athlete, a coach and/or Propel Pro, an athlete (or a minor athlete's parent or legal guardian) must read our Biometric Data Collection and Use Policy and sign the consent form.
Interactions with Minor Athletes, and Parental Rights & Notices
A multitude of federal and state laws apply to interactions with minors for their protection. A minor athlete is defined as an athlete under the age of 18 years old or the age of majority in such minor's local jurisdiction, whichever occurs later ("Age of Majority"). Propel Pro values the protection of minor athletes, and therefore requires compliance with all laws pertaining to minors. Listed below are some of those laws, which are not meant to be a complete list of all laws pertaining to minors.
- Attempting to obtain a minor athlete's contact information, including without limitation, their personal email address, their social media account handles, their phone number, or their physical residential address or other such address including, but not limited to, a training or practice location, is strictly prohibited.
- Parents or legal guardians may, at any time, observe their minor athletes while using the Services. All interactions and communications through the Services between an adult and a minor athlete must be open, transparent, observable and interruptible. Open and transparent means the communication must not be programmed to disappear or otherwise be deleted for the intention of keeping the message private from a parent or legal guardian; observable means the interaction must be easily seen by a parent or legal guardian; and interruptible means the interaction must be easily stopped by another person. Communications with minor athletes outside the Services are strictly prohibited (e.g., through direct messages via social media accounts).
- If you are a coach, and a minor athlete has been injured or becomes ill while using the Services under your purview, you must notify the parent or legal guardian through the platform for all injuries or illnesses if an athlete is under 16 years of age, or for serious injuries or illnesses if an athlete is over 16 but under the Age of Majority. Serious injuries or illnesses include, but are not limited to, concussions, SCA, heat injury/illness, faintings or other loss of consciousness, and broken bones.
- If you are a coach and suspect or know a Propel Pro minor athlete is enduring child abuse, even if such abuse is occurring outside the Services, you agree to comply with all laws, including but not limited to mandatory reporting laws.
- Alleged violations of these Rules pertaining to minors must be reported immediately (within 24 hours) to an officer of Propel Pro and to law enforcement (if the matter involves possible criminal conduct).
Consequences
Any alleged misconduct will be reviewed by Propel Pro. If, at the sole discretion of Propel Pro, an action is found to be in violation of codes of conduct or other such rules, consequences will include, but not be limited to, warnings, penalties, limitations of Services functionalities, suspension and termination of your relationship with Propel Pro and/or the Services.
